TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions govern all purchases and interactions with David Valle conducted on our website, in person, via telephone, or through direct communication (email, WhatsApp, etc.). By placing an order with us, you agree to be bound by these Terms. If you do not accept these conditions, please do not proceed with any order.

2. Product Descriptions & Pricing

All descriptions, images and price quotations are provided as accurately as possible. We reserve the right to correct any errors in pricing or descriptions before finalising a sale.

Prices are quoted at the time of consultation or communication and may be subject to change without notice.  If the quotation is increased after a deposit has been paid, then the client has the right to receive a refund of the deposit amount.

Requests for changes or alterations after work has begun may incur additional charges.

3. Deposits & Payments

A non-refundable deposit is required to confirm your order. The balance must be paid before collection or delivery. In some cases, staged payments may be agreed upon. Failure to complete payment within 6 months may result in the forfeiture of your deposit unless otherwise agreed in writing.

4. Goods Held in Trust & Recovery of Outstanding Debts

If any goods (including jewellery, gemstones, or other items) are entrusted to David Valle by a customer or third party, and there exists an outstanding debt owed to us by that same individual or company, we reserve the right to withhold such goods until the debt is settled in full.

In the event that the outstanding balance remains unpaid for a period exceeding six months from the date of the original invoice or agreed due date, we reserve the right to recover the owed amount by disposing of or selling the entrusted goods. Any proceeds from such sale will first be used to cover the debt, including any associated storage, administrative, or legal costs. Any remaining balance (if any) may be returned to the owner of the goods at our discretion.

We will make reasonable attempts to notify the debtor prior to taking such action. However, failure to respond or settle the debt within the stated timeframe will constitute consent to this clause.

5. Delivery & Collection

Items may be collected in person or delivered by prior arrangement.  Responsibility for the item passes to you upon collection or upon delivery confirmation.

It is your responsibility to arrange for collection within a reasonable timeframe.

6. Resizing

Resizing of rings made correctly to the client’s specifications will incur a charge.

7. Returns & Cancellations

Cancelled orders during manufacture may result in the forfeiture of the deposit paid and be subject to an additional fee depending on the progress of the item.

(1) Non-Bespoke Goods

We accept returns on non-bespoke, non-customised items within 14 days of receipt, provided they are unworn, undamaged, and returned in their original packaging.  You must contact us to arrange the return.

[2] Bespoke or Custom Made Goods

Custom or bespoke jewellery is made specifically to client specifications and is therefore non-refundable, unless previously agreed in writing.  Whilst the amount paid is non-refundable, we will put right any issues that arise such that the jewellery is of satisfactory quality.

8. Faults & Repairs

You must inspect your item at the time of collection or immediately upon delivery. If any fault or damage is discovered, you must inform us as soon as possible.

We offer a 2 year guarantee on our goods, not including wear and tear, accidental damage, or loss.  We reserve the right to repair the goods to satisfactory quality or replace the goods.  Repairs requested outside of warranty will be quoted on a case-by-case basis.

9. Care & Maintenance

Jewellery should be checked and cleaned regularly to maintain its condition. We recommend servicing items annually including checking that all stones are secure. Damage caused by neglect or lack of care may void the warranty.

10. Diamond Sourcing

We only source diamonds from suppliers who comply with the Kimberley Process.

11. Legal Liability

David Valle is not liable for any indirect, incidental, or consequential damages arising from the purchase or use of our products. Our maximum liability is limited to the purchase price of the item.

12. Ownership & Submissions

All CAD designs, sketches, or concepts remain the intellectual property of David Valle unless transferred by written agreement.
